What is statutory paternity pay (SPP)?

If you are having a baby, your husband/partner may be entitled to SPP if you meet the criteria:


  • The employee must be the husband/partner of the mother expecting.
  • Be employed up to the point the baby is due.
  • Provide 15 weeks’ notice before the week the baby is expected (this can be changed with 28 days’ notice)
  • Explain the level of leave required.
  • Been employed for at least 26 weeks up to any day in the qualifying weeks.
  • You can claim £172.48 per week in the year 2023-24 or 90% of your average earnings, for a maximum of two weeks.
